TERMS AND CONDITIONS FOR THE SALE OF SERVICES ON THE WEBSITE WWW.SZLAKIEMRZEMIOSLA.PL

Effective May 1, 2026.

§1. Definitions

The terms used in the Regulations mean:

  1. Seller / Service Provider Damian Nowak, operating his business under the name Dobrze Zrobione Damian Nowak, located at Afrykańska Street 3/20, 03-966 Warsaw, NIP 1132884611;
  2. Service - website at www.szlakiemrzemiosla.pl;
  3. Client – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality who enters into an Agreement with the Seller;
  4. Consumer – Client who is a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity (Art. 22¹ of the Civil Code);
  5. Entrepreneur with consumer rights – a natural person conducting business activity, entering into an Agreement directly related to their business activity, when the content of the Agreement indicates that it does not have a professional character for that person (Art. 7aa and Art. 38a of the Consumer Rights Act);
  6. Listing – electronic service consisting of publishing a Client's entry in the Service within the „Events / Fairs / Workshops” category for a specified period;
  7. Event – trade fair, festival, market, workshop, or other event to which the Listing pertains;
  8. Service Mission – promotion of Polish production and Polish craftsmanship and handicrafts;
  9. Contract – a Listing sales agreement concluded between the Seller and the Customer via the Service or by email correspondence;
  10. Payment operator – PayPro SA with its registered office in Poznań, ul. Pastelowa 8, 60-198 Poznań, Tax ID 7792369887, KRS (National Court Register) 0000347935 (Przelewy24);
  11. Terms and Conditions – these regulations.

§2. General Provisions and Seller's Data

  1. The Regulations define the rules for the sale of Listings on the Service, the rules for providing electronic services, and the rights and obligations of the Client and the Seller.

  1. The Client is obliged to read the Terms and Conditions before entering into the Agreement. Entering into the Agreement signifies acceptance of the Terms and Conditions.

§3. Technical Requirements and Terms of Use of the Service

  1. Proper use of the Service requires: a device with internet access, a current web browser with cookies and JavaScript enabled, and an active email account.
  2. The client undertakes not to introduce any unlawful content to the Service, including content that infringes the rights of third parties, good morals, or legal regulations.
  3. The Seller makes every effort to ensure the uninterrupted operation of the Service, but reserves the right to temporary technical breaks necessary for maintenance or updates.

§4. Subject of the Service

  1. The subject of the Agreement is the publication of the Listing on the Website in the „Events / Fairs / Workshops” category.
  2. The listing includes, in particular:
  1. Event Name,
  2. Event Date,
  3. photo or photos,
  4. Organizer's description,
  5. Optional – embedded video content from social media.
  1. The listing is published from the date of its publication on the Service until the end of the day following the day the Event ends, after which it is automatically deleted or archived.
  2. The base price of a single listing is 99,00 PLN gross VAT exemption (see §8). The price may change due to additional services (e.g., Featured Listing, additional items, promotion) or current promotions. The binding price is always presented to the Customer in the cart before placing an order or before accepting an individual quote.

§5. Conclusion of Agreement via the Service

  1. Placing an order on the Service includes the following steps:
  1. Selection of listing and filling out the event data form,
  2. providing Customer data required for the execution of the Agreement and the issuance of the sales document,
  3. Read and accept the Terms and Conditions (checkbox),
  4. In the case of the Consumer and PnPK, express consent to the commencement of the Service provision before the expiration of the withdrawal period and confirmation of knowledge of the loss of the right of withdrawal after full performance of the Service (checkbox),
  5. Choosing a payment method and making the payment,
  6. placing an order by clicking a button clearly indicating the obligation to pay.
  1. The agreement is concluded upon the effective placement of an order. The Seller will promptly confirm the conclusion of the Agreement by sending an email to the address provided by the Customer.

§6. Individual Valuation (email channel)

  1. A client interested in publishing more listings or custom services (e.g., a package promoting several events) can request an individual quote at kontakt@szlakiemrzemiosla.pl, specifying the scope of the expected service.
  2. The seller presents an offer within 3 business days of receiving the inquiry. The offer includes, in particular, the scope of services, price, method and payment terms, and the offer's validity period.
  3. The agreement is concluded upon the Customer's express acceptance of the offer sent in response to the e-mail address indicated in para. 1.
  4. The provisions of §§ 7–16 of the Regulations shall apply accordingly to Agreements concluded under the individual valuation procedure, subject to individual arrangements resulting from the offer.

§7. Price and Payment Methods

  1. All prices on the Service are gross prices, expressed in Polish zlotys. The Seller uses the exemption from VAT on the basis of art. 113 sec. 1 of the Act on Tax on Goods and Services.
  2. The client can pay by:
  1. through the Payment Operator – Przelewy24 (PayPro SA), in accordance with the terms and conditions of this operator available on the website www.przelewy24.pl,
  2. by traditional bank transfer to the Seller's bank account:

    Transfer title: order number.
  1. The moment of payment is considered to be:
  1. in case of payment through a Payment Operator – the moment the Seller receives confirmation of payment from the Operator,
  2. in case of traditional bank transfer – the moment the Seller's bank account is credited.
  1. The payment deadline is 7 days from the date of the Agreement. Failure to pay within this period entitles the Seller to cancel the order, of which the Customer will be informed by email.

§8. Invoices

  1. The seller uses the exemption from Value Added Tax based on Article 113 (1) of the VAT Act and issues invoices without VAT (or receipts).
  2. The sales document is issued by the 15th day of the month following the month in which the sale was made and sent to the Customer's e-mail address. By accepting the Regulations, the Customer agrees to receive invoices in electronic form.
  3. If you require an invoice with details other than those provided in the order, the Customer should report this before the document is issued to kontakt@szlakiemrzemiosla.pl.

§9. Service Performance (Listing Publication)

  1. After payment is made and complete materials are submitted, the Listing undergoes a verification process for compliance with the Service Mission.
  2. The seller verifies within 3 business days from the date of receiving payment and the complete materials.
  3. The verification criterion is the Event's compliance with the Service's Mission, i.e., its connection with Polish production or Polish craft and handicrafts.
  4. In case of positive verification, the Seller shall publish the Listing immediately and inform the Customer via email.
  5. In case of negative verification, the provisions of §11 apply.

§10. Listing Content and Customer Responsibility

  1. The Client bears sole responsibility for the content of the Listing, including the accuracy of the Event data and the rights to published photos, descriptions, and embedded videos.
  2. The client declares that:
  1. he has all the rights to the materials published in the Listing, to the extent that allows their publication on the Service, or that he has obtained the appropriate consents and licenses,
  2. published content does not infringe on the rights of third parties, including copyrights, personal rights, image rights, or legal regulations,
  3. In the case of embedding video materials from social media, these materials are publicly available and their embedding complies with the terms of service of the source platform.
  1. The Seller is not responsible for content posted by the Customer. If the Seller receives official notice or credible information about the unlawful nature of the content, the Seller will immediately disable access to it.
  2. The Client undertakes to indemnify the Seller against any claims by third parties related to the content of the Listing and to cover reasonable defense costs.

§11. Moderation and Refusal of Publication

  1. The seller is entitled to refuse the publication of a Listing in the event of:
  1. Event-Service Mission Discrepancies,
  2. discrepancies in the Listing's content with the law, good practices, or the Regulations,
  3. infringement of third-party rights by the Listing content,
  4. providing false or incomplete data regarding the Event.
  1. The Seller shall inform the Customer by email of the refusal to publish, stating the reason for the refusal, within the period specified in §9 sec. 2.
  2. In case of refusal to publish, the Seller returns the full amount received to the Customer within 14 days from the date the Customer is informed of the refusal, to the bank account or in the manner in which the payment was made.
  3. After the Listing is published, no returns will be accepted, subject to the provisions regarding the right of withdrawal and complaints.

§12. Complaints

  1. Complaints regarding the Service should be sent to kontakt@szlakiemrzemiosla.pl.
  2. The complaint should include customer data, order identification, and a description of the irregularities and the customer's request.
  3. The seller considers the complaint within 14 days from the date of its receipt and informs the Client about the resolution method to the Client's e-mail address. Failure to respond within this period in the case of a complaint filed by a Consumer or PnPK shall be deemed an acceptance of the complaint.

§13. Right of Withdrawal from the Agreement

  1. Consumer and PnPK have the right to withdraw from the Agreement within 14 days from the date of its conclusion, without giving a reason.
  2. Withdrawal can be made, in particular, by sending a statement to the address kontakt@szlakiemrzemiosla.pl. A sample withdrawal form is Appendix No. 1 to the Regulations; its use is not mandatory.
  3. Loss of the right of withdrawal. Pursuant to Art. 38 point 1 of the Consumer Rights Act, the right of withdrawal shall not apply if the Seller has fully performed the Service with the express and prior consent of the Consumer or PnPK, who was informed before the commencement of performance that upon full performance of the Service, they would lose the right of withdrawal. Placing an order by ticking the checkbox referred to in §5 sec. 1 letter d constitutes such consent and confirmation. The full performance of the Service is the publication of the Listing on the Site.
  4. In the event of effective withdrawal from the Agreement before the publication of the Listing, the Seller shall refund the full amount received within 14 days of receiving the statement, in a manner analogous to the payment made.
  5. The provisions of this paragraph do not apply to Customers other than a Consumer or a Sole Proprietor.

§14. Personal Data Protection (GDPR)

In accordance with Article 13 of the GDPR, the Seller informs that:

  3. Goals and foundations of processing:
  1. entry into and performance of the Agreement – Art. 6(1)(b) GDPR,
  2. fulfillment of tax and accounting obligations - Art. 6 sec. 1 lit. c GDPR,
  3. establishing, exercising or defending legal claims – Art. 6(1)(f) GDPR (legitimate interests of the controller),
  4. Handling correspondence regarding requests for individual valuations – Art. 6(1)(b) or (f) GDPR.
  1. Data recipientsPayment operators, hosting and email providers, accounting office, law firms, public authorities authorized by law.
  2. Storage period: data is processed for the period of contract execution and the statute of limitations for claims, and for tax and accounting obligations – for the period required by law.
  3. Data subject rightsaccess to data, rectification, erasure, restriction of processing, objection, data portability, withdrawal of consent where processing is based on consent (without prejudice to the lawfulness of processing carried out prior to the withdrawal), and the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).
  4. Voluntarinessproviding data is voluntary, but necessary for the conclusion and performance of the Agreement.
  5. No profilingdata are not subject to automated decision-making, including profiling.

§15. Out-of-court dispute resolution

  1. The consumer has the option to use out-of-court complaint and redress mechanisms, in particular:
  1. to contact the district (city) consumer ombudsman or a social organization whose statutory duties include consumer protection,
  2. utilizing mediation conducted by the Provincial Inspectorates of Trade Inspection,
  3. to use the European Commission's ODR platform, available at https://ec.europa.eu/consumers/odr The platform provides an access point for consumers and businesses seeking out-of-court dispute resolution for contracts concluded online.
  1. The use of out-of-court complaint and claim resolution methods is voluntary.

§16. Final Provisions

  1. The regulations come into force on May 1, 2026.
  2. The Seller reserves the right to amend these Terms and Conditions for valid reasons (changes in law, changes in the scope of services, technological or organizational changes). The Seller will inform about the changes by publishing a new version of the Terms and Conditions on the Website. The Regulations in their previous wording shall apply to Agreements concluded before the changes come into effect.
  3. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  4. In matters not regulated by the Regulations, the provisions of Polish law shall apply, in particular the Civil Code, the Act on Consumer Rights, the Act on the Provision of Electronic Services, and GDPR.
  5. The competent court for resolving disputes arising from Agreements concluded with Customers who are not Consumers or PnPK is the court competent for the Seller's registered office. Disputes with Consumers and PnPK shall be resolved by competent courts in accordance with the provisions of the Code of Civil Procedure.
