Video Recording Policy<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t

Effective May 1, 2026.<\/h4>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

\u00a71. General Provisions<\/span><\/h4>

  1. These regulations specify the rules for carrying out video recordings in studios, workshops, and during events, as well as the rules for their subsequent publication.<\/p><\/li>

  2. The recording producer is Well done, Damian Nowak<\/span>, Afryka\u0144ska Street 3\/20, 03-966 Warsaw, NIP 1132884611 (hereinafter referred to as the \u201eImplementer\u201d).<\/p><\/li>

  3. The mission of the Implementer is to promote Polish craftsmanship and artisanal skills, as well as Polish production.<\/p><\/li>

  4. The materials are published on the websites szlakiemrzemiosla.pl and goodplacewarsaw.pl, as well as on the profiles @goodplacewarsaw and @szlakiemrzemiosla on Facebook, Instagram, TikTok, and YouTube.<\/p><\/li><\/ol>

    \u00a72. Definitions<\/span><\/h4>

    Whenever the regulations refer to:<\/p>

    1. Director<\/span> \u2013 means the entity indicated in \u00a71, paragraph 2;<\/p><\/li>

    2. To the person being recorded<\/span> \u2013 this means the natural person appearing in the recording, including the owner or representative of the studio, workshop, or company that the recording concerns;<\/p><\/li>

    3. Free recording<\/span> \u2013 this means a recording made free of charge, on the terms indicated in \u00a73 para. 1;<\/p><\/li>

    4. Paid cooperation<\/span> \u2013 this refers to a recording made on commission and for remuneration, in accordance with \u00a73 paragraph 2;<\/p><\/li>

    5. Material<\/span> - this means a assembled, ready-to-publish audiovisual work resulting from a recording;<\/p><\/li>

    6. Artisan \/ Craftsman<\/span> \u2013 this means a natural person or a micro-entrepreneur who independently produces craft or handmade products, does not employ more than 5 employees, and does not derive the main income from mediating in the sale of third-party products.<\/p><\/li><\/ol>

      \u00a73. Scope of Services and Payment<\/span><\/h4>

      1. Free recordings<\/span> are due to artisans and craftspeople within the meaning of \u00a72 item 6.<\/p><\/li>

      2. Paid collaboration recordings<\/span> concerns<\/p><\/li><\/ol>

        1. firms employing more than 5 employees,<\/p><\/li>

        2. entities generating revenue from intermediation in the sale of craft goods, which they do not produce themselves.<\/p><\/li><\/ol>

          Valuation is carried out individually, in accordance with current market rates, based on a separate agreement between the parties before the recording begins.<\/p>

          1. Trade fairs and events can be placed on the site map after submission via the form on the website. https:\/\/szlakiemrzemiosla.pl\/dodaj-listing\/<\/a>.<\/li><\/ol>

            \u00a74. Implementer's Reservations<\/span><\/h4>

            1. The director reserves the right to refuse to produce a recording without stating a reason \u2013 for both free and paid collaborations.<\/p><\/li>

            2. In the case of free recording<\/span> The Producer also reserves the right to refuse publication of the recorded Material without providing a reason.<\/p><\/li>

            3. In the case of paid cooperation<\/span> Section 2 does not apply. If the Implementer decides not to publish the Material created within the paid cooperation, they shall return the remuneration received in full within 14 days from the date of the decision.<\/p><\/li><\/ol>

              \u00a75. Consent to the dissemination of likeness<\/span><\/h4>

              1. The person being recorded, by participating in the recording, expresses free of charge<\/span> consent to the dissemination of their image and voice recorded in the Material, in accordance with Article 81 of the Act on Copyright and Related Rights.<\/p><\/li>

              2. The agreement covers the following fields of exploitation:<\/p><\/li><\/ol>

                1. Fixing and duplicating by all techniques, in particular digital and audiovisual ones;<\/p><\/li>

                2. entering into computer memory, into telecommunications networks, and into the Internet;<\/p><\/li>

                3. publicly making the Material available in such a way that anyone can access it at a place and time of their choosing, in particular on the websites szlakiemrzemiosla.pl and goodplacewarsaw.pl and on the @goodplacewarsaw and @szlakiemrzemiosla profiles on Facebook, Instagram, TikTok, and YouTube.;<\/p><\/li>

                4. assembly, framing, adding subtitles, background music, voice-over, translations, and combining with other materials;<\/p><\/li>

                5. use of the Material (in whole or in part) for promotional and marketing purposes by the Contractor and the services and profiles specified in letter c.<\/p><\/li><\/ol>

                  1. The agreement covers the granting of further licenses (sublicenses) to intermediary platforms, in particular Meta Platforms, TikTok, and Google (YouTube), to the extent resulting from the terms and conditions of these platforms, to the degree necessary for the publication of the Material.<\/p><\/li>

                  2. Consent is granted indefinitely<\/span>, until the moment of its effective withdrawal, and without territorial limitations<\/span> (the whole world), due to the nature of its distribution on the Internet.<\/p><\/li>

                  3. Consent is granted in oral form, captured on recording<\/span> \u2013 the fact of the recorded person's participation in the recording and their on-camera consent constitutes consent within the meaning of this paragraph.<\/p><\/li><\/ol>

                    \u00a76. Copyright to Material<\/span><\/h4>

                    1. The economic copyrights to the recording and the Material belong exclusively to the Producer.<\/p><\/li>

                    2. The person being recorded is not entitled to any copyrights or property claims against the Producer by virtue of their participation in the recording.<\/p><\/li>

                    3. The recorded person is not authorized to independently publish, distribute, or commercially use the Material without the separate, written consent of the Producer.<\/p><\/li><\/ol>

                      \u00a77. Recording Person's Liability<\/span><\/h4>

                      1. The person being recorded bears sole responsibility for which elements of their studio or workshop activities they present on camera, in particular with regard to:<\/p><\/li><\/ol>

                        1. trade secrets, proprietary production techniques, recipes, know-how;<\/p><\/li>

                        2. third-party rights (copyright, industrial property, personal rights);<\/p><\/li>

                        3. contractual obligations to contractors.<\/p><\/li><\/ol>

                          1. The recorded person declares that the publication of the accepted Material does not infringe upon the rights or interests of third parties.<\/p><\/li>

                          2. The recorded person undertakes to obtain the consent of third parties who will appear in the frame (e.g., employees, collaborators, clients), or to inform the Producer before the recording if those persons need to remain anonymous (e.g., by not including them in the frame or blurring their image in post-production).<\/p><\/li>

                          3. The producer is not responsible for third-party claims directed at the Recorded Person arising from the infringements referred to in paragraphs 1\u20133.<\/p><\/li><\/ol>

                            \u00a78. Safety on set<\/span><\/h4>

                            1. The person being recorded assures that the filming location meets health and safety requirements and that individuals on set have been informed of potential hazards related to the studio's specific nature (e.g., open flames, machinery, tools, chemical substances).<\/p><\/li>

                            2. The developer is liable only for damages caused by willful misconduct or gross negligence.<\/p><\/li>

                            3. The person being recorded is responsible for the safety of people and property in the studio during the recording, according to general rules.<\/p><\/li><\/ol>

                              \u00a79. Verification and Acceptance of Material<\/span><\/h4>

                              1. After the recording is made, the material is sent to the person being recorded for verification.<\/p><\/li>

                              2. In the case of free recording<\/span>:<\/p><\/li><\/ol>

                                1. Failure to accept the Material within 7 days of its submission will result in the archiving of the Material and its non-publication;<\/p><\/li>

                                2. If, after archiving, the recorded person expresses a desire to publish the Material, its publication is possible only within a separate, paid service, priced according to current market rates.<\/p><\/li><\/ol>

                                  1. In the case of paid cooperation<\/span> Verification is used to submit comments regarding the content of the Material. Failure to submit comments within 7 days of submission will be considered acceptance of the Material in its submitted form.<\/p><\/li><\/ol>

                                    \u00a710. Withdrawal of consent for the dissemination of image<\/span><\/h4>

                                    1. The person being recorded has the right to withdraw their consent for the dissemination of their image at any time by sending a statement to the email address indicated in \u00a713.<\/p><\/li>

                                    2. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.<\/p><\/li>

                                    3. The Controller shall remove the Material from the channels (websites and social media profiles) managed by them within 14 days of receiving the statement withdrawing consent.<\/p><\/li>

                                    4. The producer is not responsible for:<\/p><\/li><\/ol>

                                      1. copy of material previously fixed by third parties,<\/p><\/li>

                                      2. the functioning of social media platform algorithms (in particular recommendations, shares, reposting by users),<\/p><\/li>

                                      3. Material disseminated or archived by parties other than the Implementer.<\/p><\/li><\/ol>

                                        \u00a711. Personal Data Protection (GDPR)<\/span><\/h4>

                                        Pursuant to Article 13 of the Regulation of the European Parliament and of the Council (EU) 2016\/679 of 27 April 2016 (GDPR), the Provider informs that:<\/p>

                                        1. Data controller<\/span> The person being recorded is Damian Nowak, conducting business under the name Dobrze Zrobione Damian Nowak, located at Afryka\u0144ska St. 3\/20, 03-966 Warsaw, Tax Identification Number (NIP) 1132884611.<\/p><\/li>

                                        2. Contact the administrator<\/span> Regarding personal data processing: kontakt@szlakiemrzemiosla.pl.<\/p><\/li>

                                        3. Personal data<\/span> (including image and voice) are processed for the purpose of:<\/p><\/li><\/ol>

                                          1. execution and publication of recordings and promotion of Polish craftsmanship and handicraft \u2013 based on the consent of the data subject (Art. 6(1)(a) and Art. 9(2)(a) of the GDPR);<\/p><\/li>

                                          2. performance of the contract in the case of paid cooperation (Article 6(1)(b) GDPR);<\/p><\/li>

                                          3. fulfilling legal obligations incumbent upon the administrator, in particular tax and accounting obligations (Art. 6(1)(c) GDPR);<\/p><\/li>

                                          4. settlements, investigations, or defense against claims \u2013 based on the legitimate interest of the controller (Article 6(1)(f) GDPR).<\/p><\/li><\/ol>

                                            1. Data recipients<\/span> may include: hosting service providers, e-mail service providers, accounting service providers, law firms, as well as social media platform operators (Meta Platforms Ireland Ltd., TikTok Technology Limited, Google Ireland Ltd.) \u2013 to the extent necessary for the publication of the Material.<\/p><\/li>

                                            2. Transfer to third countries<\/span>data may be transferred outside the European Economic Area in connection with the use of social media platform services. The transfer takes place on the basis of appropriate safeguards, in particular standard contractual clauses approved by the European Commission and, with regard to the USA, on the basis of the European Commission's decision on an adequate level of protection (\u201eData Privacy Framework\u201d).<\/p><\/li>

                                            3. Data retention period<\/span>:<\/p><\/li><\/ol>

                                              1. image and voice in the published Material \u2013 until the effective withdrawal of consent by the Recorded Person;<\/p><\/li>

                                              2. data related to the agreement \u2013 during its performance and the period for which claims arising from it are statute-barred;<\/p><\/li>

                                              3. data processed for tax and accounting purposes - for the period required by law.<\/p><\/li><\/ol>

                                                1. The data subject has the right to<\/span>:<\/p><\/li><\/ol>

                                                  1. access to data,<\/p><\/li>

                                                  2. I apologize.,<\/p><\/li>

                                                  3. removal,<\/p><\/li>

                                                  4. processing limitations,<\/p><\/li>

                                                  5. object to processing,<\/p><\/li>

                                                  6. data transfer,<\/p><\/li>

                                                  7. withdrawal of consent at any time (without prejudice to the lawfulness of processing carried out before its withdrawal),<\/p><\/li>

                                                  8. filing a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).<\/p><\/li><\/ol>

                                                    1. Providing data is voluntary, however, it is necessary to participate in the recording and its publication.<\/p><\/li>

                                                    2. Data is not subject to automated decision-making, including profiling.<\/p><\/li><\/ol>

                                                      \u00a712. Final Provisions<\/span><\/h4>

                                                      1. The regulations come into force on May 1, 2026.<\/p><\/li>

                                                      2. The Organizer reserves the right to amend these regulations. The Organizer will inform about changes by publishing a new version of the regulations on the websites szlakiemrzemiosla.pl and goodplacewarsaw.pl. For recordings started before the changes come into effect, the provisions of the regulations in their current wording shall apply.<\/p><\/li>

                                                      3. If any provision of these regulations is found to be invalid or unenforceable, the remaining provisions shall remain in effect.<\/p><\/li>

                                                      4. In matters not regulated by these regulations, Polish law applies, in particular the Civil Code, the Act on Copyright and Related Rights, and the GDPR.<\/p><\/li><\/ol>
